I wish to record for failure upon my own but the lawyer. Besides stuffing out paperwork, do we need to crop up in court? we see no alternative approach than filing failure to get out of debt. Credit conversing is not assisting as well as we wish to begin fresh. we have schooled my lesson.

I am going to strongly advise you to have an attorney do your BK.
Since the law changed a few years ago, it became very difficult to understand all of the rules. Many attorneys that did BK’s occasionally stopped doing them because it got too complex, and the liability for a goofed up BK was on their shoulders.
If you file one wrong form, neglect to include something, miss a date, or do any of a thousand possible errors, your trustee is not going to have any sympathy for you.
Your case will be dismissed, and you will not be able to refile for 6 months. During that time period, your creditors are going to work very fast to get their judgments and recover whatever they can as fast as possible, before you can file again.
I know someone who had their BK dismissed, and the next day the car got picked up by a repo agency.

I was going to say ask your lawyer. But you indicate you plan on not using one. Believe me, your creditors will. You sure you want to do this without a lawyer? I’m sure you heard the old saying. A person who represents themselves in court has a fool for a client. Hire a lawyer.

While somethings are very easy to defend yourself in court. This doesn’t work with everything. Filing bankruptcy isn’t as easy as it use to be. Especially with the new laws.
Stop being cheap and find a reasonably priced lawyer. I filed and it cost me $800. I re-affirmed my car and they tossed out everything else. They will usually allow you to pay in 3-4 installments.
You will have to appear in Court. Normally, you will not see the bankruptcy judge – it will be the bankruptcy trustee assigned to your case.
I agree with the other posts that you should contact a lawyer. Many have payment plans so that you can afford their services. The laws are complicated (due to the 2005 bankruptcy reform), and their are now more steps involved. I have included a link below to a helpful website that explains the Chapter 7 bankruptcy process.
